Lindsay Clancy’s lawyer challenges evidence that she killed her children
After a deadlocked jury, Clancy’s lawyer argued there was not enough evidence to prove she killed her children.

At a hearing after Lindsay Clancy’s murder trial ended in a deadlocked jury on Sept. 4, her lawyer argued there was not enough evidence to prove she killed her three children. MedPage Today reported the jury was split 11 to one in her favor. During the trial, the defense did not dispute that Clancy killed the children, instead arguing she was not criminally responsible because of mental disease. Her lawyer now says the evidence does not establish that she killed them. Prosecutors maintain that there was enough evidence to convict her, and said the state met its burden.
The judge did not immediately rule on the defense request for acquittal, and no retrial date was set. Prosecutors have not decided whether to retry Clancy, according to the Plymouth County district attorney. They could pursue first-degree murder charges, seek lesser charges or drop the case. Clancy remains charged with murder and is expected to stay at a psychiatric hospital until her case is resolved.
